1. Provider and Scope

These General Terms and Conditions (“T&Cs”) apply to all orders placed through the online shop at www.ikus-watches.ch.

The contracting party and seller is:

Hereinafter referred to as “IKUS WATCHES”, “IKUS”, “we” or “us”.

By placing an order, the customer accepts the Terms and Conditions applicable at the time of the order.

For consumers whose habitual residence is outside Switzerland, any mandatory consumer protection provisions applicable in their country of residence remain unaffected.

2. Offers and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer.

By completing the checkout process and submitting the order, the customer makes a binding offer to purchase the products contained in the shopping cart.

After receiving the order, the customer will receive an automatic order confirmation by email. This initially confirms only that the order has been received.

The purchase contract is concluded once IKUS WATCHES expressly accepts the order, sends a shipping confirmation or dispatches the goods.

IKUS WATCHES reserves the right to reject an order for objective reasons, including obvious pricing errors, lack of product availability or suspected fraudulent or abusive orders.

Any payments already made will be refunded in full in such cases.

3. Products and Product Presentation

IKUS WATCHES develops and assembles mechanical watches in small quantities. The watches are assembled and inspected by hand.

The essential characteristics of each product are described on the respective product page in the online shop.

Product photographs and illustrations are intended to provide the most accurate representation possible.

Minor variations in colour, surface appearance or workmanship that are technically unavoidable or result from manual assembly and do not affect the functionality or quality of the product do not constitute a defect.

Mechanical watches may exhibit technical variations in timekeeping accuracy. Variations within the specifications stated on the product page or specified for the movement used do not constitute a product defect.

4. Prices

The prices displayed in the online shop at the time of the order apply.

Prices are shown in the currency indicated in the online shop or during checkout.

Where applicable, any legally due Swiss value-added tax (VAT) is included in the displayed price.

Shipping costs and any additional charges are displayed to the customer before the order is completed.

For deliveries outside Switzerland, import VAT, customs duties, customs clearance fees or other governmental charges may apply.

5. Payment

The payment methods available are those displayed during checkout.

Payment processing is subject to the terms and conditions of the respective payment provider.

The goods remain the property of IKUS WATCHES until full payment has been received, insofar as permitted by applicable law.

6. Product Availability

IKUS watches are produced and offered in small quantities. Product availability may therefore be limited.

If an ordered product unexpectedly becomes unavailable after conclusion of the contract, we will inform the customer as soon as possible.

If the order cannot be fulfilled, any payments already made for the unavailable product will be refunded in full.

For products expressly marked as Pre-Order, the estimated delivery information stated on the respective product page applies.

7. Delivery and Shipping

Delivery is made to the shipping address provided by the customer when placing the order.

Available delivery countries, shipping methods, shipping costs and estimated delivery times are stated in our Shipping Policy and during checkout.

Unless expressly agreed otherwise, delivery times are estimates.

International deliveries may be delayed due to customs clearance, public authorities, local holidays or local delivery services.

8. Risk During Shipping

For sales to consumers, IKUS WATCHES generally bears the risk of loss or damage during transport until the goods have been properly delivered to the customer or to a person authorised by the customer to receive them, unless mandatory applicable law provides otherwise.

Customers are requested to inspect the package for visible transport damage upon receipt and to report any such damage to IKUS WATCHES as soon as reasonably possible.

Failure to report transport damage immediately does not affect the customer's statutory rights.

9. Customs Duties, Taxes and Import Charges

For deliveries outside Switzerland, import VAT, customs duties, customs clearance fees or other charges may be imposed in the destination country.

If these charges are not expressly shown during checkout as included or prepaid, they are generally the responsibility of the recipient.

If taxes, customs duties or import charges are expressly shown during checkout as included or prepaid, the customer will generally not be required to make any additional payment to IKUS WATCHES for those specified charges.

IKUS WATCHES has no control over additional charges imposed by foreign authorities due to specific import regulations, subsequent changes in legislation or incorrect or incomplete information provided by the customer.

10. Returns and Right of Withdrawal

Returns, refunds and withdrawals are governed by the separately published Return and Withdrawal Policy of IKUS WATCHES.

Any mandatory statutory consumer rights remain unaffected.

11. Defects and Statutory Warranty Rights

IKUS WATCHES warrants that the products supplied conform to the agreed characteristics at the time of delivery.

For customers in Switzerland, the applicable provisions of Swiss law apply.

For consumers outside Switzerland, any mandatory statutory rights relating to defects, conformity or legal guarantees under the applicable consumer protection laws remain unaffected.

Mandatory statutory rights are not limited by the voluntary manufacturer's warranty described below.

12. Voluntary IKUS Manufacturer's Warranty

In addition to any statutory rights, IKUS WATCHES provides a voluntary two-year manufacturer's warranty from the date the watch is received.

The manufacturer's warranty covers material and manufacturing defects, including defects resulting from manufacturing or assembly despite proper use of the watch.

After examining the product, IKUS WATCHES will determine whether a defect covered by the warranty will be remedied by repair, replacement of a component or, where necessary, replacement of the watch.

The manufacturer's warranty does not cover, in particular:

  • normal wear and ageing;
  • scratches, dents or other cosmetic signs of use;
  • normal wear of straps, bracelets, clasps and comparable wear parts;
  • damage caused by drops, impacts, accidents or improper handling;
  • damage caused by unauthorised opening, modification or repairs performed by unauthorised third parties;
  • damage resulting from use outside the stated product specifications;
  • water damage demonstrably caused by an improperly screwed-down crown, physical damage, improper use or use beyond the stated water-resistance rating.

Water ingress caused by a material, assembly or sealing defect is not excluded from the manufacturer's warranty.

Any statutory warranty, conformity or defect rights remain unaffected by this voluntary manufacturer's warranty.

13. Water Resistance and Proper Use

The water-resistance rating of each watch is stated in the respective product description.

For watches equipped with a screw-down crown, the crown must be fully screwed down before the watch comes into contact with water.

The crown must not be opened or operated while the watch is under water.

Following a repair, opening of the case by a third party or significant mechanical impact, a new water-resistance test may be required.

14. Liability

IKUS WATCHES is liable in accordance with mandatory statutory provisions.

To the extent permitted by applicable law, liability for slight negligence as well as indirect damages, consequential damages and loss of profit is excluded.

This limitation does not apply in cases of intent or gross negligence, injury to life, body or health, or where liability is mandatory under applicable law, including applicable product liability legislation.

15. Incorrect Shipping Address and Uncollected Shipments

The customer is responsible for providing complete and correct shipping information when placing an order.

If a shipment is returned to IKUS WATCHES due to an incorrect address provided by the customer, failure to collect the shipment or a refusal of delivery attributable to the customer, any additional shipping, return transport, customs or handling costs actually incurred may be deducted from the amount refunded, to the extent permitted by applicable law.

Mandatory consumer rights remain unaffected.

16. Returns

Please contact IKUS WATCHES before returning any product at:

We will provide you with the current return address and the necessary return instructions.

The business address of IKUS WATCHES should therefore not automatically be used as the return address, as the return address may differ.

For consumers exercising a statutory right of withdrawal, prior contact does not constitute an additional condition for the valid exercise of that right.

17. Intellectual Property

All content on this website, including trademarks, logos, product names, texts, photographs, designs, graphics and other materials, is owned by IKUS WATCHES or used with the appropriate authorisation.

Reproduction, modification or commercial use without prior permission is prohibited unless permitted by applicable law.

18. Data Protection

Information about how we collect and process personal data can be found in our Privacy Policy.

19. Amendments to these Terms and Conditions

IKUS WATCHES may amend these Terms and Conditions for future orders.

The version of the Terms and Conditions applicable at the time the contract is concluded applies to each individual order.

20. Governing Law and Jurisdiction

These Terms and Conditions and the contractual relationship between IKUS WATCHES and the customer are generally governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers whose habitual residence is outside Switzerland, this choice of law does not deprive them of any mandatory consumer protection provisions of the country in which they have their habitual residence that cannot legally be excluded.

To the extent legally permissible, the place of jurisdiction is the registered place of business of IKUS WATCHES in Switzerland.

Mandatory statutory jurisdictions available to consumers remain unaffected.

21. Severability

If any provision of these Terms and Conditions is or becomes wholly or partially invalid or unenforceable, the validity of the remaining provisions shall not be affected.

The applicable statutory provisions shall apply in place of the invalid or unenforceable provision.
